1. Definitions
In these Terms and Conditions:
- "Brightvine" / "We" / "Us" / "Our" refers to Brightvine, registered in Tainan, Taiwan.
- "Service" refers to in-home elderly care and assistance services offered by Brightvine, including Morning & Evening Routine Help, Household & Meal Support, and Personalized Full-Day Care.
- "User" / "You" refers to any individual accessing this website or entering into a service agreement with Brightvine.
- "Client" refers to the elderly individual receiving care services.
- "Agreement" refers to the written care plan and service agreement entered into by Brightvine and the family or legal representative.
2. Acceptance of Terms
By accessing this website or entering into a service agreement with Brightvine, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use this website or engage our services.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement on behalf of yourself or the client.
3. Service Description
Brightvine provides non-medical in-home elderly care and assistance services in the Tainan area of Taiwan. Our services include personal hygiene support, meal preparation, light housekeeping, medication reminders, and social engagement. We do not provide medical treatment, nursing care, or emergency medical services.
Service availability is subject to caregiver availability and geographic coverage. We will communicate any limitations clearly before a care plan is confirmed.
4. Care Plan and Service Agreement
All care provision is governed by a written care plan agreed upon by the family or authorised representative and Brightvine. The care plan specifies the services to be provided, the visit schedule, and the applicable pricing. No care begins before a written agreement is in place.
Care plans are reviewed periodically and may be amended by mutual written agreement. Either party may request a review at any time.
5. User Responsibilities
You agree to:
- Provide accurate and complete information during the care planning process
- Ensure the home environment is reasonably safe for caregivers to work in
- Notify Brightvine promptly of any changes to the client's health or circumstances
- Treat Brightvine caregivers with respect and dignity at all times
- Not request caregivers to perform tasks outside the agreed care plan
Prohibited Activities
- Soliciting or directly employing Brightvine caregivers outside of the Brightvine arrangement
- Requesting caregivers to perform tasks that are unsafe, unlawful, or outside their training
- Using this website for unlawful purposes
6. Intellectual Property
All content on this website โ including text, design, and structure โ is the property of Brightvine or its licensors. You may not reproduce, distribute, or adapt any content without written permission. You are granted a limited, non-exclusive, non-transferable licence to access and view this website for personal information purposes only.
7. Payment Terms
Service fees are as published on our Solutions page and confirmed in the written care agreement. Payment is due as specified in the care agreement. Prices are stated in New Taiwan Dollar (NT$). We accept payment by bank transfer.
Brightvine reserves the right to adjust pricing with reasonable advance notice. Any price changes affecting an existing agreement will be communicated in writing at least 30 days before taking effect.
Cancellation and Refunds
Cancellations with more than 48 hours notice are accepted without charge. Cancellations with less than 48 hours notice may incur a partial visit fee as specified in your care agreement. Requests for refunds on unused paid periods will be considered on a case-by-case basis.
8. Disclaimers
Brightvine provides non-medical home care services. We do not provide medical advice, diagnosis, or treatment. Nothing communicated by our caregivers or coordinators should be interpreted as medical guidance. Families should consult appropriate healthcare professionals for all medical matters.
Our services are provided with reasonable care and professionalism but without any warranty of specific outcomes. Individual results will vary depending on the client's circumstances.
9. Limitation of Liability
To the maximum extent permitted under applicable law in Taiwan, Brightvine's liability in connection with our services shall not exceed the total fees paid for the relevant service period. We are not liable for indirect, incidental, or consequential losses arising from use of our services or this website.
We are not liable for circumstances outside our reasonable control, including natural disasters, government actions, or caregiver illness, provided we have taken reasonable steps to arrange backup coverage.
10. Termination
Either party may terminate the care agreement with 14 days written notice. Brightvine may terminate with immediate effect in cases of material breach, unsafe conditions, or conduct harmful to our caregivers. Fees for services already delivered are non-refundable.
11. Dispute Resolution
In the event of a dispute, we encourage parties to first seek resolution through direct communication with our care coordination team. If informal resolution is not possible, disputes shall be subject to the jurisdiction of the courts of Taiwan, with governing law being the laws of the Republic of China (Taiwan).
12. General Provisions
- Entire Agreement: These Terms, together with the written care plan, constitute the complete agreement between the parties.
- Severability: If any provision is found unenforceable, the remainder of the Terms continues in full effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of future enforcement.
- Assignment: You may not assign your rights under this agreement without Brightvine's written consent.
13. Changes to These Terms
We may revise these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of our services or website after changes are posted constitutes acceptance of the revised terms.
